A True Assessment of California Propositions

Here is a guide that I hope you will find helpful as you prepare to make decisions on how you will make an informed vote on the five Propositions that will be on the ballot Tuesday, June 8th.
 
If you are anything like I am, I really don’t enjoy reading someone else’s interpretation of what I’m quite capable of reading myself if I had any desire to do so.  Therein is where the problem lies.  We pay good money in taxes to send representatives, who receive adequate compensation, to Sacramento to make our lives easier by representing us and our best interests.  Somewhere between their home districts and Sacramento they lose perspective and begin serving their personal ideology and special interests.
 
I studied each Proposition purely on the merit of what it means, with no spin, and no regard for party or special interest.  The overriding element of this study would be the amount of hype and advertising dollars/time each Proposition receives.  As an example Prop 13 would have a low advertising budget as compared to Prop 16.  Why would that be?  If a Proposition needs a sales pitch to make it worthy, then somebody or some group stands to gain from making it seem appealing beyond its own individual merit.  If you base your decision on the commercials you see or read your vote on these Propositions will not be an educated vote.

Proposition 13, Seismic Retrofitting was written and presented by Republican Roy Ashburn, who is an admitted homosexual, and was arrested for DUI March 3, 2010. Then at trial on April 14th Ashburn pled no contest to 2 counts of driving while intoxicated.  He was sentenced to 2 days in jail and 3 years probation.  Additionally his driver’s license was suspended, he has to attend a class for DUI offenders, and pay fines and fees of nearly $2,000.  But, besides that he’s a helluva fella!  The Democrats and AFSCME seem to think this is a good measure therefore it triggers an automatic skepticism in me.  The overall consensus of opinion is this is a beneficial measure and will not only exclude costly assessments for the taxpayer for safety purposes, but encourage retrofits for earthquake safety compliance sake, and after study I agree.  Vote YES on Prop 13
 
Proposition 14, Open-primary ballot measure was written and presented by the California Legislature.  Oops!  There’s a deal breaker for me right out of the chutes.  Well if some of you feel our Legislators have just done a crackerjack job and haven’t run California right into the ground, read on!  On March 12, 2010 Supreme Court Judge Allen Sumner ruled that the wording had to be changed.  Just the fact that Proposition 14 was subject to a lawsuit just two months ago makes me suspicious that the merit of this measure has nothing to do with a benefit to the voter.  Besides everything, here are two substantial reasons I have no use for this measure.  I want to know what party affiliation a primary candidate represents.  I don’t want my choices limited to the two candidates that accumulated the most primary votes in spite of party affiliation.  I want the ability for a write-in candidate for the general election, oh wait that’s three reasons, I’m sorry! Without any reservations  Vote NO on Proposition 14.
 
Proposition 15, Public Funding of Some Elections was originally written and presented by State Senator Loni Hancock from Berkeley. Another measure taken to court that resulted in language adjustment because of ambiguity.  I already have a huge dislike for the campaign spending during State and Federal elections (e.g. Whitman $71M, Poizner $25M)  Come on people who's buying whom or what here?  The shape of our current economy (especially California) makes the campaign spending allowed an atrocity. I will make two statements that should be enough to enlighten any who read this. The impact of this measure would only involve the election of the Secretary of State in 2014 and 2018. THE PASSAGE OF THIS MEASURE WOULD REPEAL THE CALIFORNIA-VOTER APPROVED BAN ON THE PUBLIC FINANCING OF CAMPAIGNS. What would be refreshing to see would be a new measure written between now and 2014 that would put an equal ceiling for each candidate of privately donated funds with no public funding and put a stop to candidates or special interests buying public office. Until that time arrives there is no suggestion other than to Vote NO on Proposition 15.
 
Proposition 16 (to amend the Constitution), the New Two Thirds Requirement for Local Public Electricity Providers Act being pushed as the Taxpayers Right to Vote.  This act is sponsored by PG&E which to my way of thinking has special interest written all over it.  I know of no one on the face of this earth that abhors big government and supports free enterprise more than I do.  I detest special interest groups, monopolies, and restriction of any method of preventing taxpayer savings.  I also don’t like the government sticking their nose into things (private enterprise & liberty) that it doesn’t belong in.  With that said I urge every Californian to quit watching these propaganda commercials pro and con and do some research and educate yourself.  If you must take the easy way out then take my word for it because I have studied it.  No brief paragraph on this one.
 
I normally wouldn’t resort to acknowledging Berkeley Law in fear that I may become permanently left-handed but they really have a pretty good independent analysis on Prop 16.  I’m going to get right to the point by having you answer some simple questions in your own mind.  Why would PG&E spend $41.1 million pushing this Proposition if it was such a great thing for us?  Ben & Jerry’s don’t have to spend a dime to get me to think a pint of Cherry Garcia is a good idea! Why is Proposition 16 an amendment to the Constitution as versus a statutory initiative or legislation?  Does the 2/3rd- majority vote protect the taxpayer or make it harder for the monopoly to be challenged by publicly provided power?  Why is this referred to as the Taxpayers Right to Vote Act, don’t we already have that right?  Why would the taxpayers want to shut the door or make it so difficult (2/3rd-majority) for the competing rates from public utilities to be an option?  Proposition 16 is clearly in favor of special interests.  This Prop is presented as a Constitutional amendment and no movements on less than a 2/3rd-majority vote, making this measure one that would be around forever.  It doesn’t need to be a Constitutional amendment and all the voting does not warrant a 2/3rd-majority to safeguard the taxpayer.  The whole structure of this measure seems like the fox guarding the hen house.  Vote NO on Proposition 16.
 
Proposition 17, Allows Auto Insurance Companies to Base Their Prices in Part on a Driver's History of Insurance Coverage Initiative Statute.  Now that’s a mouthful. In short, this measure would allow auto insurance companies to give what is known as a persistency discount and could be based on an insurer’s carryover experience from a previous carrier.  Previously Proposition 103 did not allow that type of flexibility because when someone changed carriers they lost the previous carriers experience for longevity and any discount applied to that feature.  Mercury Insurance is the sponsor for Prop 17 and has already contributed $13.5 million on this measure, why?  On the surface this measure allows the insured to retain their continuous insured longevity even though they switched carriers, and it sounds pretty good.  A person would then be able to shop around for a lower rate and still be able to take advantage of a discount that the previous carrier allowed for your loyalty.  There is a hidden agenda in this measure.  It will allow Mercury to lowball some insured to capture their business, but would now have a method to raise premiums on others to make up for the discount offered their newfound business.  What we have going on here is more of that special interest stuff like we saw in Prop 16 with an attempt to manipulate the voters to alter an existing law for huge gains.  Vote NO on Proposition 17.

Democrats Leave Millions Of Unemployed Hung Out To Dry Until Mid April

In an absolute cowardly move in order to score political capital the Democrats in a party line vote denied Republican legislation that would have used unspent stimulus funds to extend unemployment benefits without having to "add one dime" to the nation’s already crippling debt.  Instead the Democrats chose to hightail it out of Washington on their Easter recess.  After all the administration had already dictated that health care legislation is their #1 priority, not the well-being of unemployed Americans.

Senator Tom Coburn pressed forward knowing that he would be lambasted by the Democrats and demonized by the liberal media. He tried to exercise at least some fiscal responsibility in this perpetual spending madness that seems to evade the conscience of the Democrats.  There is no wrong in what Tom Coburn did; he acted prudently with easily sustainable options.  Why is it that Democrats see a problem in using unspent stimulus funds to bridge a gap?  If the stimulus funds are allocated to a specific area enlighten all of us.  We could accept that quicker than just "because we said so."  Then the question would be tell us why we couldn’t use some of the returned stimulus funds to bridge the gap in unemployment benefits Mr. Majority Leader?  Once again if all those funds are appropriated to a specific program already tell us what that might be?  You see it is crystal clear to me that the Republicans want to solve some problems that the Democrats want to ignore.  They unsuccessfully offer solutions for not adding to the deficit by putting the money where their bill is!  The solution is so obvious even a caveman can figure it out.  It just escapes a Speaker and a Senate Majority Leader.

When Harry Reid had the opportunity to make things right before he fled Washington for Easter recess, he chose to stick it to millions of Americans by allowing the unfortunate who rely on unemployment benefits to wait on the edge of uncertainty.  Why he would be in such a hurry to get home to Searchlight Nevada escapes me because I don’t think the Tea Party Express had a scheduled stop to pick him up at the airport.  It may also be safe to assume that those banners and signs he will see are not going to read "Welcome Home" or "Nice Job Harry" for a Senate Majority Leader whose popularity ratings are lower than whale droppings. There may even be credibility to the possibility he will be joining other celebratory Democrats in some remote unnamed location. At their hideaway they will hold SEIU paid press conferences berating the Republicans for how they insensitively denied unemployed Americans a benefit extension the Democrats tearfully requested.

There is nothing worse than being out of work wondering how you will be able to make ends meet.  It is very safe to say that very few if any Congressional leader ever missed a meal or wondered where their next dollar would come from.  It is despicable of the Congress to leave Washington D.C. and sleep at night knowing they could have prevented the angst of millions of Americans.  With even a shed of compassion could they tell the same Americans that are wondering if they will have a roof over their head that this health care bill was more important than their security?  Could these same fools honestly say there was no time for a bill to be ironed out so millions of Americans might spend Easter without a lump in their throat?

Let us set the record straight and tell the truth Congress.  Did Senator Coburn or Bunning do the wrong thing when there were clear options to rectify stopgap legislation without increasing the deficit?  The answer is a resounding no!  Were their motives political?  I don’t know the answer to that, nor does it really matter, because the direction of it was what should be motivating every one of you spineless wonders.  Not all Republicans or Democrats are contaminated by this political chicanery and the informed American has had quite enough.  There is an underlying evil in this country that needs to be dealt with.  It doesn’t really matter which side of the aisle you are on, the American people are looking for leaders and as far as I can tell none exist.  I see a spattering of strong individuals, some with admirable qualities, but a true leader has the ability to bring those individuals together.  Weakness can be best recognized when an individual is only capable of bringing like minds together to achieve their selfish interests.  If God is not at the center of your life stay home you have nothing to offer.

This ought to be an interesting Easter recess.  There are a number of you that are just political parasites and you will be greeted by your constituents in a fashion that may not appeal to you.  Those of you that are under the false impression that listening to the people is unnecessary because your superior intellect and experience in life puts you ahead of those you serve, hold that thought because reality bites.  Any one of you that has uttered the words "Yeah, but the Democrats/Republicans did/used that when…". You have to be kidding me.  I remember when my children were youngsters that childish philosophy was played out tirelessly.  When they would get caught or found doing something that was a violation of rules or unacceptable behavior the typical excuse rolled out. But Billie did it!  Gee, the Smith’s let their kids do it!  Suzie always gets away with that!  Sound familiar?  Wrong is wrong.  Rules are rules.  Everything isn’t to our liking.  Inappropriate behavior and poor choices result in consequences, no exceptions.  Congress can and should neutralize a president, ask Bill Clinton.  A president should be the glue not the mold.  I’ve never heard a president and an administration whine so much.  Every other word is inherited, and if it was too much to handle the entire administration should not have taken on the responsibility.  Businesses aren’t run from textbooks, only experience prepares business owners. Finally I hate to bust the shift the blame bubble for the Democrats, but you have been the majority in Congress since January 2007. Why that is such a seldom mentioned fact is puzzling, and the executive branch does not make the legislative branch unless of course Congress is inept or malfeasance in their duties and allows it.

In The Last Few Days We Have All Witnessed Politics In One Of It’s Darkest Hours

Republican Senator Jim Bunning has become the new whipping boy for the Democratic Party because of his bold move to filibuster the passage of a $10 billion bill to address the highlighted unemployment benefits extension among other measures.  Senator Bunning should be applauded for the courage to speak out on such a contentious issue, because each and every dime spent by Congress, until the deficit is neutral, should be paid for by cuts or raised revenue.  That bill could have been passed last week had the congressional leadership been willing to make the right moves to fund the bill.  The Democratic leadership seized a political moment and were too ignorant to recognize that they could have emerged heroic if they had chosen to do the right thing.  The Democratic leadership could have easily found the $10 billion in unspent stimulus funds, returned T.A.R.P. funds, or God forbid a cut in spending in the dozens of pork ridden bills already earmarked.

Read some of the complaints from the Democratic geniuses.  Vice-President Joe Biden, "At a time when so many families are in so much pain we shouldn't be shutting the few valves of relief. ... We should be opening that spigot a little wider not shutting it down."  I guess someone forgot to tell the Vice-President there is nothing left on the other side of the spigot, and the sympathy card has been played to death!  Also Vice-President Biden if you really are as concerned about the welfare of the families in so much pain, where were you?  You are President of the Senate, why didn’t you derail this foolishness?

Senator Bunning whether purely politically motivated or not made a common sense statement, "If we can't find $10 billion to pay for something that we all support, we will never pay for anything on the floor of the U.S. Senate."  That was a reasonable question for the Senator to present, but it was immediately rebutted by Senate Majority Leader Harry Reid, "Where was my friend from Kentucky when we had two wars that were unpaid for during the Bush administration?"  Leave it to, soon to be ousted, Harry Reid to play the Bush card!  My guess, Senator Reid, was that your friend was right there on the Senate floor with you playing politics as usual and this may be hard for you to grasp but that was then and now is now.

On 01/28/2010 the Senate reinstated the PAYGO rules in a party line 60-40 vote.  It is unclear why the Republicans would not want to be a part of a measure to assure funding for any appropriation without adding to the deficit.  The intent of this measure enforces a rule requiring tax increases or spending cuts in any bills that increase entitlement spending or cut taxes, so it would appear Senator Bunning had every right to insist appropriate action be taken.

One thing should be clear to all Americans by now that these politicians have no concern for the people that they represent.  Every part of the $10 billion bill could have been discussed and worked out beforehand.  Instead these politicians decided to play with the security and peace of mind of millions of Americans for the political mileage they can generate.  The thought that 535 elected individuals can live as nobility and toy with trusting Americans lives is unconscionable.

Observations on Obama's Early Marxism: Augustine 25 Interviewed by Ronald Kessler of Newsmax

I was deeply honored to get a call from Ronald Kessler of Newsmax this week regarding the publication of an interview he did with me regarding Barack Obama's early, strong commitment to radical ideology.

Personally, I thought it was telling that Obama never comes clean about the level of his intense commitment to Marxist philosophy during his years at Occidental College in his book Dreams of My Father.

To me this was a warning sign that there was something Obama was hiding from the American people.  After all, I'd see his commitment to the idea of Marxist revolution face to face when I met him in the fall of 1980.  At the very least, I thought candidate Obama owed the American people a description of how, if at all, he had outgrown his earlier faith in Marxism and socialism.

Nevertheless, it was quite interesting to see a national level journalist tear into my memories and check out my story. Kessler, as you may know, is the journalist who figured out that Mark Felt was the true identity of "Deep Throat." Tea Party National Convention: Showcase For Sarah Palin Or Springboard For The Tea Party Movement?

After only minutes of an analysis of Sarah Palin’s speech to the Tea Party National Convention, I had to turn it off. Sarah Palin is always good medicine for ailing conservative values and the Washington D.C. penchant to eradicate them.  She gave a good speech, and tried very hard to define that neither she, nor any leader defines the Tea Party Movement, and I commend her for that.  In spite of all we have seen from this convention the media, including FOX’s Geraldo Rivera, tries to define this Tea Party Movement as partisan (GOP), or a start of a third party.  The media wouldn’t understand the Tea Party Movement if it came up and kissed them on the lips!  The media’s theory is that if you oppose Obama’s policy, you must be a Republican, or anti-Democrat.  If you embrace conservative principles and the Constitution you must be some kind of a right-wing nut job who defies progress according to the liberal media.  The media’s intelligence isn’t deep enough to put all the pieces together from across the nation that have been unfolding from the Tax day rallies, town hall meetings, the march on Washington, to the statements made in recent elections. The media has been ignoring to purposely being deceitful about the Tea Party Movement, that they have begun to believe their own lies about the lack of seriousness motivating this movement.

The current administration cannot acknowledge the Tea Part Movement because if they did it would validate the fear they have of how serious and powerful this movement is.  Already the GOP is trying to identify with it, and conservative Democrats readily acknowledge it.  The Tea Party Movement has always been an independent outcry of angry and concerned AMERICANS that are fed up with how many of our elected officials have self-proclaimed a form of nobility that they believe they are entitled to.  The GOP can only identify with the Tea Party Movement because of the similarity in principle, and even then far too many have strayed from those basic principles into a more progressive behavior.  We know who you are!

I have news for Geraldo Rivera and Juan Williams, Sarah Palin is not our leader, nor has she been behind what drives us!  Quit trying to analyze something you don’t understand, and we owe you no explanation.  We need no leader to guide us to right and wrong, our founding fathers define us!  The Constitution defines us, and not the lame watered-down version based on precedence of case studies the progressives would have us believe!  What will truly define us, is our continued vigilance to refine those in office that represent us until we replace every politician with a patriot willing to restore America to the greatness, liberty and prosperity that are OUR rights.

POTUS vs. SCOTUS, Or The Arrogance of Inexperience!

The aftershock of the State of the Union address to the nation will reverberate for some time to come.  We have grown to understand the constant rhetoric coming from a president whose only worthwhile capacity is that of a consummate pontificator, or in street corner terms, a union or community organizer capable of manipulating the ill-informed.  If our President were stripped of his academic book smarts, he would have little to offer beyond his skills to talk a good talk.  His practical skills and experience in the real world are personified by his lack of acumen in matters that ail this country for addressing what is best beyond his own narrow ideology.

During the State of the Union address the President made use of his often abused bully pulpit to publicly criticize the Supreme Court’s 5-4 decision to support the 1st Amendment rights of corporations and unions to advertise their support for candidates.  The personhood of corporations has been a hotly contested topic for many decades, and it is not likely to end anytime soon.  The President may not like a decision made by the Supreme Court, but in a total display of his personal ideology used a national stage to condemn their decision.  It shows his inexperience in practicality of a clearly elementary understanding of "praise in public, criticize in private"!  He couldn’t even stop at his total disregard for etiquette, but continued by encouraging Congress to enact legislation that would strike down the Supreme Court decision.  It is not only clear that this President has not learned a single lesson in his first year in office, but he is apparently tone deaf to he and Congress’s penchant for arrogance.  As patriots we should all long for the day that Congress is bold enough to enact legislation that limits a capped campaign contribution to only the individual registered voter.  With today’s media tools available, the only uninformed voter is probably someone that has no intention of voting. We should wholeheartedly agree with part of a statement the President did make.  "I don’t think American elections should be bankrolled by America’s most powerful interests, or worse, by foreign entities."  My suggestion would totally eliminate any threat of that.  Unfortunately, the President just wants big business out of the way.  He slid into White House on special interest campaign contributions so his appeal to Congress was disingenuous at best.

The rebuke of the Supreme Court on national TV and broadcast worldwide shows how dangerous this President is for the future of America.  When we are faced with the financial uncertainty of our country, out-of-control unemployment, mishandling of security and terrorism, how do unrelated Supreme Court decisions and homosexual rights fit into the catastrophic mix?  They don’t!  This President has no intention of doing anything to promote bipartisanship, transparency, free market enterprise, or cut spending.  The next three years will be a quagmire of legislation, large and small, that will haunt any patriotic American for decades.  We have an opportunity in November 2010 to make Barack Obama a lame duck President, and there should be no more urgent a call for the Tea Party Movement.

Do They Hear Us Yet?

While basking in the contentment of Scott Brown’s Massachusetts Senate victory it didn’t take long to be rocked into reality by a senseless article that showed up as a top story from CNN on my mobile phone. The article was written by CNN’s political editor Mark Preston who shared his analysis of the change in political narrative for 2010 as a result of the history that was made by Scott Brown’s win. I found the article exasperating because even after more than a year of Tea Party activity ignored, mocked, and worst of all disrespected, even the crowning event of Scott Brown’s election did not pay proper homage to the efforts of millions of Americans. I decided to react by expressing myself in the most therapeutic way for me, by writing. I thought to myself, ok settle down and get a cup of coffee, because as angry as I am my frustration will come out as a string of expletive deletives towards this hack at CNN, thus more on this feeble attempt at an analysis in a bit.

Collecting in my mind some of the disappointments I’ve felt over disparaging comments and dismissal of "We the people" I have witnessed over this past year have to come from one of the most vile creatures to contaminate the air waves, MSNBC’s Keith Olbermann. He truly outdid himself the other day in his vitriol assessment of Scott Brown. Over this past year no reference has offended me more than the use of the word "teabagging". Coming from the mouth of Olbermann should be no surprise though because his constant reference to it would indicate that he is the quintessential expert on the practice. Then we have the President of (the Liberal Democratic Progressive movement) America pounding out his typical rhetoric as the bipartisanship guru of all times mocking the Tea Party Movement. Then the "Queen of elitists" who personifies the reason why America is failing puts her two cents in about the validity of the Tea Party protests. The assault on the Tea Party Movement by our current administration continues to fan the flames of a growing blaze that will not be extinguished.

If Mark Preston at CNN is the best political expert they have it is no wonder they are failing. His analysis is so far off the mark that he is probably suppressing talent that work under his tutelage that see reality beyond his ideology. The analysis of sorts smacked of being from a Democratic viewpoint and took no direction from a neutral perspective. The leading indicator in the direction of this analysis came from an interview with New Hampshire Democratic Party Chairman Ray Buckley. He was quoted as writing, "Over the past few weeks, RADICAL RIGHT-WINGED activists turned Massachusetts into ground zero for the Tea Party movement and we saw a taste of what’s to come in 2010." So now we are to assume that radical right-winged activist over night transformed more than a million independent thinking Massachusetts voters into a radical right-wing machine. To think there is any outside force capable of changing the minds of one of the most independently liberal thinking Democratic states is laughable. Any credible analyst would have at least made mention of, how preposterous that notion is, without giving some credibility to the Massachusetts voter for being upset with the direction this administration and our country is going.

Mr. Preston and his anonymous Democratic operative and staffer who contributed to this factual packed analysis give way too much credit to the GOP for anything that happened in Massachusetts. News flash from the Tea Party Movement, one year later the Republican Party continues to be "disoriented, disorganized and disillusioned." The GOP was slow to jump on the bandwagon in support of Scott Brown, "we the people" and more exact the voters of Massachusetts are the true motivating forces behind this succinct message to Washington D.C. No matter what side of the aisle you are on, you better start listening to the will of the people or we will crush you!

The huge difference in the political narrative for the next three years is not how the Democratic or Republican parties can strengthen but rather how America can strengthen and regain the sovereignty and freedoms it has been stripped of by both parties. By the way Mr. Preston, with all due respect for the dead, I believe Kennedy took his seat with him! If you are referring to the once empty Senate seat "We the people" decided to let Scott Brown sit in it for awhile and do Massachusetts proud.

Things That Should Really Concern Us About H.R. 3962 Or Any Healthcare Reform

The following excerpts from the latest installment of the House bill, which will join the Senate bill, are slow reading and an entanglement of legalistic jargon, but clear enough to understand the mindset of the Legislative branch of our government.  There is an agenda to reshape America and the current administration is the focal point. Those in Congress that are in line with the current administration will be driven to produce sweeping legislation, but understand that even in the Democratic party concessions will have to be made to get a foot in the door.  It doesn’t take over 2,000 pages of either House or Senate bills to legislate fixes for what ails our current health care system.  It does take 2,000 pages or more though to hide the ominous threat this takeover of our current system will entail.
 
To give instant credibility to my interjected commentary I provided some examples verbatim from the House bill. This was done to illustrate a point of how far-reaching and complex the lawmakers will go to create a maze to confound the masses.  Keep in mind the following is just a grain of sand from the vast expanse on a beach of sand.
 

TITLE I—IMMEDIATE REFORMS

SEC. 101. NATIONAL HIGH-RISK POOL PROGRAM.

  1. IN GENERAL.—The Secretary of Health and Human Services (in this section referred to as the ‘‘Secretary’’) shall establish a temporary national high-risk pool program (in this section referred to as the ‘‘program’’) to provide health benefits to eligible individuals during the period beginning on January 1, 2010, and, subject to subsection (h)(3)(B), ending on the date on which the Health Insurance Exchange is established.

(b) ADMINISTRATION.—The Secretary may carry out this section directly or, pursuant to agreements, grants, or contracts with States, through State high-risk pool pro-

grams provided that the requirements of this section are met.

Hope you have been brushing up on your understanding of ERISA Employer Retirement Income Security Act, Social Security Act, Internal Revenue Code of 1986, and Public Health Service Act because they will be referred to many times throughout this behemoth bill.

How is this High-Risk Pool that starts up (a bit presumptuous) only a week after Christmas 2009 going to be funded you ask?  It’s crystal clear right here!

(h) FUNDING; TERMINATION OF AUTHORITY.—

(1) IN GENERAL.—There is appropriated to the Secretary, out of any moneys in the Treasury not otherwise appropriated (since we are already operating at a deficit I’m not quite sure how that works?), $5,000,000,000 to pay claims against (and administrative costs of) the high-risk pool under this section in excess of the premiums collected with respect to eligible individuals enrolled in the high-risk pool. Such funds shall be available without fiscal year limitation. (Excuse me?)

(2) INSUFFICIENT FUNDS.—If the Secretary estimates for any fiscal year that the aggregate amounts available for payment of expenses of the high-risk pool will be less than the amount of the expenses, the Secretary shall make such adjustments as are necessary to eliminate such deficit, including reducing benefits, increasing premiums, or establishing waiting lists. I’m sorry I could have sworn I just read eliminate deficit by reducing benefits, increasing premiums, or establishing waiting lists?

 

SEC. 1122. MISVALUED CODES UNDER THE PHYSICIAN FEE SCHEDULE.

 

  1. IN GENERAL.—Section 1848(c)(2) of the Social Security Act (42 U.S.C. 1395w-4(c)(2)) is amended by adding at the end the following new subparagraphs 

They change the scope of the Social Security Act in order to increase spending by $20M for something that is already funded with no reports from the GAO of benefit received. It appears there is a black hole for appropriation of funds with no true accountability. In the back-swing they take out parts of the Balanced Budget Act of 1997 and CMS oversight that was an advisory council which evaluates government health services. How convenient!

 

(b) IMPLEMENTATION.—

(1) FUNDING.—For purposes of carrying out the provisions of subparagraphs (K) and (L) of 1848(c)(2) of the Social Security Act, as added by subsection (a), in addition to funds otherwise available, out of any funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary of Health and Human Services for the Center for Medicare & Medicaid Services Program Management Account $20,000,000 for fiscal year 2010 and each subsequent fiscal year. Amounts appropriated under this paragraph for a fiscal year shall be available until expended.

Wait that’s not enough let’s make this section as nefarious as possible and allow sweeping powers to the Secretary of Health and Human Services in order to fly under the radar.

 

(2) ADMINISTRATION.—

(A) Chapter 35 of title 44, United States Code and the provisions of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to this section or the amendment made by this section.

(B) Notwithstanding any other provision of law, the Secretary may implement subparagraphs (K) and (L) of 1848(c)(2) of the Social Security Act, as added by subsection (a), by program instruction or otherwise.

You have heard it mentioned before I’m sure, but if this or any similar bill passes we will begin paying for it and being taxed immediately, and we will receive no benefit from it until as late as the year 2014.  That means the government intends to fund this monstrosity and begin the infrastructure to support it.  Most Americans can’t even phantom how big our government currently is and this bill will grow it to a staggering workforce beyond anything we have ever seen. Actually it makes Obama prophetic even though he has been a little slow at the trigger and chronically deceitful, but he may just create the 2.5 million jobs he promised.  Unfortunately, they will all be government jobs because private sector jobs would violate his and the administrations ideology for redistribution of wealth.

This administration has been hell on words as we comprehend them. Besides a sea of rhetoric unlike any we have ever heard, we are now faced with a mid-stream change in terminology, and just flat out documented lies. Two of the biggest bombs to me were changing "terrorism" to "man caused disasters" because apparently what it really is may be too scary, and; when "Global Warming" became too dicey, it was then referred to as "Climate Change". It makes one wonder just what this administration means, exactly, by "Healthcare Reform"? Occasionally I have even heard Obama say "Overhaul" which takes on a completely different meaning, and would truly limit what we are seeing the Democrats doing. This administration as early as during Obama’s campaigning has tagged "Healthcare Reform" as near sacred an undertaking that no one from either party could possibly be against it. In talking points an opening phrase in any argument is often started with "surely you’re not against Healthcare Reform, are you?" Automatically putting any opposition on the defensive in spite of the credibility of their argument. You can pass some pretty ominous legislation with the perception you would be terrorizing a bunny rabbit if you didn’t buy everything the left was selling. I better qualify my accusation of lying, by mentioning that candidate Obama promised transparency to the degree of showing the Healthcare Reform debates in Congress on C-span. Lockheed could learn something about stealth from the Democratic Congress. The word game I am mentioning here is important because there has been a horrific spin on every piece of legislation we have had thrown at us since Obama took office. The Healthcare Reform bills in Congress are trickery to a criminal extent. If this alleged Healthcare Reform was wholesome in the slightest extent it would not have to be designed in secrecy with the opposition by a majority of voters.

There are two elements of the Healthcare reform that scare me, and I do not scare easily. Besides the many highly publicized threats to freedoms that are cleverly masked by legalese and ambiguity, the two elements I speak of have received very little attention. The first is any degree of language within the legislation which prevents the potential of any future repeal in whole or in part once the legislation is passed. No bill that passes through Congress and is signed by the President should prevent future repeal. My final concern will be in bold upper case, not because I’m angry, but because no one should allow this or any Healthcare bill to pass Congress with open-ended legislation. History is on our side with Social Security and Medicare rich with underestimates in costs and lack of fiscal responsibility by Congress. Keep in mind that Healthcare Reform is being funded by revenue from taxpayers for as long as four years before any benefit from the legislation is recognized. WE CAN NOT ALLOW TAX REVENUE INTENDED TO SET UP A FUND FOR THIS NEW HEALTHCARE TO GO INTO THE GENERAL FUND IN SPITE OF ANY GOOD INTENTIONS. The government has been robbing Peter to pay Paul ever since Social Security began. We currently have two entitlement programs that actually, on the books, ran at a surplus all but one year since their inception. Now we sit with worthless IOU’s, on the books, to make up for the loans from the funds Congress should never have touched for any reason. Do you really think the Treasury can be trusted to handle the funds for Healthcare Reform? Don’t you think it would be prudent if there was ironclad legislation with an investment plan for any funds collected by the Treasury between now and 2014?

We should have learned something from Social Security! Sure we can look into the future and forecast that it will be bankrupt under the current plan. Did it have to be that way? If there was any fiscal responsibility, oh yes and consequences, in Washington D.C., and they could invest money, as well as they spend it, our entitlement funds would be flush. WE CAN NOT ALLOW ANY TAX DOLLARS OR FEES TO GO INTO THE TREASURY GENERAL FUND FOR HEALTHCARE REFORM!

"IN GOD WE TRUST"

Today was clearly a day to celebrate, but not to rest! I learned in my lifetime that when it appears that you have achieved a goal, that is the very time to roll up your sleeves and start pushing much harder than what got you to the point you are at. This is especially true of The Tea Party Movement, and today for the first time the TRUTH prevailed. FOX news has always been on the side of telling things like they are, and has taken a lot of heat from MSM for siding with the truth. The Tea Party Movement has been scorned, mocked, ignored, dismissed, and yes ridiculed in a despicable sexual connotation by the scum of the earth that revel in the very sexual behavior they make joke of. Today, however, the clearly left leaning NBC coupled with the Wall Street Journal came out with a poll that showed that The Tea Party Movement more popular than either the Republican or Democratic party.

I truly believe that God is inspiring each and every one of us that is involved in The Tea Party Movement, no matter how big or small our contributions are. Whether we share with a friend or two, or a crowded gathering our impact will be felt. We have a God of second chances, and we need to capitalize on this divine opportunity. God inspired our founding fathers to assemble a government where HIS name would be honored above all else. In return God would bless this country beyond imagination and we would then be able to go out and share with all nations in HIS word and blessings. Our founding fathers with divine intervention gave us documents and a rich history to follow as a blueprint for eternity. God didn’t make us social introverts and slaves; HE made us bold and eager to discover all HIS blessings. Only evil and corruption wants man’s spirit crushed and defeated, and through us not being vigilant in everything we inherited from our founding fathers, we are running out of time.

The good news is God has given us another chance! HE wants us to stand up and defend HIM, honor his commandments, and above all else to honor HIS son. We need to assure all citizens that our CONSTITUTION protects those that wish to worship their god, or not, anyway they choose, but do not confuse this extended privilege as an invitation to strip us of our precious heritage. Jeremiah 17 best describes the current administration and the path this country is taking since the minority liberal progressive has had it’s way in convincing that political correctness is in and traditional values are an infringement. It’s time to draw a line in the sand and tell the progressives NOT ON OUR WATCH!

We have a golden opportunity as our numbers and the enthusiasm for The Tea Party Movement grows. We need to be smart about how we proceed and be conscious of our tactics so they do not fall into the divide and conquer strategy. As The Tea Party Movement becomes stronger the media will seek us out to question the typical who, what, when, where, and we should be united on all major goals which I believe we are. The Tea Party Movement consists of diversity contrary to what some media and brain dead politicians think, so it would be wise to all link up for unity and really show Washington D.C our thunder

The Impact Of The Tea Party Movement On Future Candidates

A new Rasmussen poll clearly substantiates the power behind the "Tea Party Movement", and the effects it will have in future elections as well as opposition to bogus legislation.  A quick search of Rasmussen polls on tea party popularity shows a movement garnering momentum and a voice that can sway almost any outcome desired.  This is evidenced by the support of tea party candidates, which breaks down the support for Democratic 36%, Tea Party 23% and Republican 18%, assuming an election were held today.

The message is clear, but I believe is being missed by both Democratic and Republican parties.  The tea party patriots are not only angry at the current administration, and tired of government intervention in their lives, but also sick of politicians in general.  The continuing rhetoric is stale and ineffective, and politicians fall far short in ability to address the new breed of well informed Americans found at the impetus of this movement.  The new breed of American Patriot is often better informed than many of the politicians who lay idle claim to representing us.  Very few politicians have any business acumen and have never made a payroll, paid business taxes, met a premium on Workers Comp, liability, or malpractice insurance.  How could it even be remotely possible that these same politicians could actually represent our best interests?

It is no longer acceptable that we put in office a representative that possesses a silver tongue, a $400 haircut, or is the first to break the glass ceiling.  We have learned the hard way that the cookie cutter image is the very thing we should be vehemently rejecting.  The new breed of representative to Congress needs to pass a litmus test far more defining than popularity and the ability to say the right thing.  Before all the blame appears to be heaped on the hundreds of dirt bags that currently represent us, we need to accept full responsibility for putting them there, and vow to be more vigilant to ourselves and future generations.

The tea party movement is just what the doctor ordered, but the movement needs to continue to grow and build momentum at ten times the rate it has since its inception.  There are many groups out there that combine at protests and scheduled events that help to fortify the movement on the whole, but it troubles me that it is fragmented to a degree.  Talk of a third party concerns me, but the opposition loves it.  First let us hypothetically create this new party and call it "Tea Party" and have an election tomorrow.  Using Rasmussen’s numbers the outcome would declare the Democratic candidate the winner with 36% of the vote followed by the Tea Party candidate with 23% and the Republican candidate 18%.  Good showing by the Tea Party candidate compared to the Republican candidate, but a loss nonetheless to the very party’s administration we want out of power.

Prudent advice would be to not introduce a third party into the mix, but allow a more united Tea Party Movement vetting the candidates in spite of the party they represent.  An endorsed Tea Party candidate would have met all the criteria or core values mandated by a united doctrine of the Tea Party Movement, which would be avowed to by oath and signature.  This is my appeal to the various patriotic sites out there to unite under one mandated doctrine that is sworn to by any candidate running for office.  There can be millions of websites out there that rally around their patriotic cause and they will not have to give up any of their autonomy to agree on a common doctrine and force candidates to comply in order to achieve an endorsement by the "Tea Party Movement".  This would solve the potential dangers of a third party doing nothing more than watering down the vote’s cast.

The Tea Party Movement has already made history, and it continues to generate a momentum equal to or surpassing the movement I witnessed in the late 60’s and early 70’s.  There is no need to repeat the history of failure of third parties.  Lessons learned and good common sense practiced could result in a public voice calling the shots for government the way our founding fathers sacrificed much to accomplish.  Now is the time for all of today’s patriots to become selfless for the cause of the American people in taking back OUR government.

The Elderly Deserve To Be Spoiled

I flip-flopped on what to do about how the Steve Chapman’s column for Townhall effected me.  I read the column twice to make sure I wasn’t being misled by my own prejudice in my respect and love for seniors.  I wasn’t wrong, this opinion column was sour grapes.  Opinions are like anuses, everybody has one!  It’s sad when a seasoned columnist fills good writing space with less than researched facts, and shallow commentary.  I apologize to anyone reading this, that I quoted Mr. Chapman’s column for flow and emphasis.  You are certainly welcome to punish yourself by going directly to Mr. Chapman’s column yourself Treating the Elderly Like Spoiled Brats


He starts out his column helping everyone understand how the economy works relative to inflation of the dollar.  "Deflation is just the opposite: You put your feet up and watch your money grow in value."  As if this is some type of an everyday occurrence, when in actuality the last time deflation (currently –0.56%) was an issue it happened the year Mr. Chapman was born.  I’m sure he remembers his grandparents with their feet up watching their social security checks and all their money almost growing out of control (1954 –0.74%).  If you look at the big picture there are times in life that things just don’t seem fair.  I distinctly remember in 1980 when inflation was 13.58% that no one came to me and said that my purchasing power sucks so we are going to reduce the amount of FICA being withheld from your paycheck to ease the pain.  I didn’t whine that those evil seniors like someone’s grandma and grandpa were going to be rewarded at my expense by a COLA increase, and I certainly didn’t suggest that they might become spoiled brats at a poverty level fixed income.  I wholly believe that Mr. Chapman's view of things would be entirely different 12-15 years from now if circumstances beyond his control placed him in a predicament that his only security ended with Social Security and Medicare.

, that’s right Steve.  Now, the greedy old seniors can toss aside that once-a-month treat night to Red Lobster and ramp up for let’s say dinner at Ron of Japan!  Need I remind Mr. Chapman that it is not the senior’s fault that the Social Security Fund is not as flush in surplus as it should be, but as a result of atrocious money mismanagement by decades of irresponsible Congressional spending.

 
Wait a minute!  Mr. Chapman still has his shorts in a knot because since deflation has hit, you seniors can’t have your cake and eat it too!  "Consumer Price Index has dropped by 2.1 percent. So in the coming year, Social Security payments will stay the same and be worth more than they used to be."  I think Mr. Chapman would be happy if you seniors returned 2.1 percent. "Groups representing the elderly, like AARP, have come to regard the annual raise as a sacred birthright in good times as well as bad" and seniors sure wouldn’t want to bear that cross because it would make them feel like UNIONS or CONGRESS.

 
A good example of these spoiled brat seniors Chapman speaks of might be the case of my own mother who just reached her 85th birthday.  She has a good life and her needs are well met.  She might fall into that category of a Social Security recipient that does not depend entirely on the entitlement. She is compassionate and understands that she is able to help her sister and other seniors with whatever benefit she receives and is mature enough to deal with whatever windfall may come her way.  After reading Steve Chapman's column, twice more than it deserved, I have arrived at the conclusion that from his perspective he could use a little attitude adjustment himself.  Oh and by the way maybe both he and the politicians should grow up!

Obama’s Far-Left Agenda Crystal Clear

In respectful response to Phyllis Schlafly’s opinion column "If Obama Had Told Us Before His Election", I disagree that what Obama has been trying to accomplish was even remotely a hidden agenda.  If we who love this country, the Constitution, and the traditional values of our heritage are appalled by what we have seen so far, the worst is yet to come.

To the discerning mind Obama's agenda was as plain as the "in the air" nose on his face!  Nobody listened.  For months before the election there were countless factual links and stories about his socialist past, my own included in Blogs and Twitter.  Nobody listened.  His past associations, ethics, political motives, racial motives, and his unequivocal thirst for power could not have been clearer.  Unfortunately, very few paid attention.

The only redemption for those independents, conservative democrats, and republicans thirsting for change that voted for Obama is a sorrowful admission of ignorance.  In all fairness to those that now suffer from buyers remorse fall into the category of naive Americans that almost refuse to believe that corruption and evil could be so prevalent among elected officials.  Obama shares the blame for decadence with Congress, and unfortunately Congress represents the elected foundation for the direction our country goes.

We have all failed the brave and unselfish founders of this great country by allowing all that is good and noble to be slowly trampled.  We now all have a call to duty with the same conviction as our forefathers to proclaim to the New World Order that hang on "yes we can" by actively defeating them with "NO YOU CAN'T", not on our watch!

I Am Ashamed Of Any Americans That Stoop To Make The Loss Of The 2016 Olympic Bid Anything More Or Less Than What It Was!

America was unable to win the bid to host the 2016 Olympics and it is clear that Rio de Janeiro was the more politically convincing city to sway the votes of the IOC, period the end. It would have been a welcome boost to have the games on American soil but now let’s cheers for Rio, because it would be the mature thing to do. After all, isn’t good sportsmanship a leading ingredient in Olympic games?

The 2016 Olympic games isn’t about GOP, DEM, Conservative, or Liberal. The fringe element in our country and the media continually tries to stir up a controversial story very often where none exists. Good case in point is Sam Stein of The Huffington Post with his "Conservatives Revel In Obama's Olympic Bid Failure" who hop-scotches through the week of news items of the week and conveniently ties them all together in a disconnected plot by conservatives and Republicans to discredit President Obama. I promise you Mr. Stein, neither you or the Huffington Post speak for me, a non-party affiliated conservative, or even come close to the whole truth in what you write. Then you quote some of the input from RedState’s Erick Erickson, Michelle Malkin, Rush Limbaugh, and others as if their point of view should be a surprise to anyone accept it helps give your drivel credibility. Then there is Roland Martin, a CNN contributor, who had an opinion in his commentary that addresses all the patriotic Americans that may not share his one-dimensional views as "Republicans" "so-called patriots" "giddy behavior". Martin challenges American patriotism because of an individual’s views and trying to shame them because they differ from his own. Martin’s own opinion is hypocritical because he clearly puts everyone on notice by stating that: "This isn’t about politics." "It’s not about ideology." Then what is it about Roland? You mentioned Republican! You made it political! Your view of what it takes to be an American patriot is ideology, is it not? What if I said, Roland more than a year before you even poked your head into this world I was in Vietnam fighting for my country, and unless you even fought in a later war you are in no position to utter the words Patriot! That’s not fair is it? To revel in the loss of being selected to host the Olympics or to label and politicize the events of the week I ask you, who is the lesser fool?

I don’t agree with many of the comments made coming from either side of the political spectrum, but what I do agree with is logic and truth in spite of who shares it. I have a self-imposed following on Twitter because I want to keep on the pulse of issues. Some of the bias is almost laughable on either side of the aisle. What I don’t understand is why writers like Sam Stein and Roland Martin are afraid to use words like "some" "a small group", and shy away from putting anyone who opposes their own views into an undesirable or unacceptable box.

The World Sinks To A New Low When A Political Dirt Bag Beats Out A Saint For The Nobel Peace Prize!

When a topic moves me emotionally, politically, or stirs my passion due to the humanitarian content, I tend to write about it.  I hope this story warms your heart and peaks your interest as it did mine.

I received a forwarded email today from a friend that actually had enough merit to share with others.  I automatically thought to myself that I ought to "tweet" this because we can all use something uplifting to pick us up while the far-left ideologues continue to try to destroy our country.

I have a rule about sharing or forwarding on the Internet only that which is the truth, and verifiable.  There will be a few links, but I encourage you to follow them and I promise you won’t be sorry you did.  They all bear out the life of a woman that we all wish we could be like from a humanitarian standpoint.  Her name is Irena Sendler(owa).   A Polish Catholic woman that was responsible for saving 2,500 Jewish children in 1942-43 during the Second World War while the Germans occupied Warsaw. With All Due Respect Speaker Pelosi, If Rhetoric Was Energy You’d Be A Power Plant!

In a press conference, Thursday 9/17/2009, Nancy Pelosi made a cheap costume jewelry performance of an emotional plea.   She said that the anti-government rhetoric over President Barack Obama's health care reform effort is concerning, because it reminds her of the violent debate over gay rights that roiled San Francisco in the 1970s.  Great analogy coming from a liberal ideologue, but way off the mark about why this country is upset.  Even as late as today’s news conference she ignores the people, their cause, and that she is one of the biggest instigators of why the citizens are upset.  Instead she showers us all with her great-grandmotherly wisdom, "I wish that we would all, again, curb our enthusiasm in some of the statements that are made.  Some of the people hearing the message "are not as balanced as the person making the statement might assume."  I was kind of thinking it is more like some of the people making the statements are not as balanced as those that hear the message!  One most recent comment was the racist accusation made by former president Carter, which only crystallizes how far out of touch the liberals are and that denial is their panacea.

"Our country is great because people can say what they think and they believe," Pelosi added.  "But I also think that they have to take responsibility for any incitement that they may cause."  Ah, no truer words were spoken Speaker Pelosi.  Speaking about responsibility, I think your interpretation of your congressional title may be askew.  KTVU 04/15/2009 "We call it astroturf" referring to the protests. 08/10/2009 Washington Examiner on a USA today op-ed quoting "an ugly campaign" Pelosi and Hoyer called the acts "simply un-American." Any more examples begin to become boring.

Just to clear up any misconception, being Speaker does not give Pelosi a pass on taking responsibility for inciting unrest, or even violence.  However, taking responsibility might be a new role for someone that has a history of blurting out "un-American" to any opposition that may interfere with her liberal agenda on health care, abortion, illegal immigration, etc.
